Ritenuto e considerato in fatto e diritto quanto segue.
FATTO e DIRITTO
1. Con sentenza n. 623/2007 il Tar per la Puglia, sezione di Lecce, ha respinto il ricorso proposto dal signor Vito Lacarbonara, che aveva chiesto la condanna del comune di Leporano al risarcimento dei danni derivanti dall’illegittimo ritardo nel rilascio del permesso di costruire in variante, richiesto dal ricorrente in data 27.12.2001.
Vito Lacarbonara ha proposto ricorso in appello avverso tale sentenza per i motivi che saranno di seguito esaminati.
Il comune di Leporano si è costituito in giudizio, chiedendo la reiezione del ricorso.
Con ordinanza n. 172/2010 questa Sezione ha ritenuto necessario disporre due consulenze tecniche di ufficio al fine di accertare:
a) il pregiudizio economico subito dall’appellante per effetto del ritardo nel rilascio del permesso di costruire in questione, to relate to the period May 2002 to May 2004, stating in particular:
- the date of conclusion of individual contracts and preliminary and final contracts concluded by the impact of delay on the conclusion of each contract;
- quantification of loss of interest bank received by the appellant as a result of the delay in the payment of fees payable upon conclusion of final contracts or further amounts paid by the same appellant the interest due to debts not extinguished or reduced because of the delay in signing of final contracts ;
- the quantification of the total capital which he has suffered injury as a result of that delay, also evaluated with regard to the whole of its assets.
b) the existence of the disease and alteration of mental status, alleged by the applicant, with date of onset and the existence or not of the causal relation to the delay in issuing the permit to build and quantification of the relative damage. Upon completion of the two
advice and filed reports, today's hearing, the case was retained in the decision.
2. The issue in this case consists of a claim for compensation for damage allegedly derived the Appellant due to the delay of the town of Leporano in issuing a permit to build variant.
I danni lamentati concernono le conseguenze derivanti dal ritardo nella stipulazione dei contratti definitivi di acquisto degli immobili da costruire, già oggetto di contratti preliminari e il danno biologico subito per effetto delle patologie insorte in conseguenza della condotta omissiva dell’amministrazione.
Il giudice di primo grado ha respinto la domanda risarcitoria, ritenendo che, pur essendo assolutamente indubbio il superamento del termine per il rilascio del permesso di costruire previsto dall’art. 20, 3°- 8° comma, del d.p.r. n. 380/2001 ed individuato in 75 giorni dal ricevimento della domanda (60 per l’istruttoria e 15 per l’emanazione dell’atto), deve essere escluso il requisito soggettivo proof of guilt on the part of the administration as a result of a particular complexity of the case and a series of eventualities that can not be attributed to the municipal administration of Leporano. The Tar
drew the following factors in order to prevent a finding of guilt of the pa:
a) the fact that the practice of construction drawings and lacked the necessary consent of Superintendence for the architectural and landscape of Puglia, documentation gained with the procedure only on 22.2.2002 (note prot. No 1739);
b) detecting the presence of two opinions expressed by the Superintendence for the architectural and landscape of Apulia, again on 18.2.2002 ( and bearing protocol numbers 3149/01 and 6883/01); detection that caused the municipal administration of Leporano (note 12/03/2002 prot. No 2388) to direct the applicant a request for exhibition of works annexed to the opinion prot. No 6883/01 (required only by the person found on 04/08/2002)
c) the need to coordinate the two opinions of the Superintendence for Architectural Heritage and the countryside of Puglia, expressed with reference to several drawings;
d ) the recognition of a contrast between the opinion prot. No 31914/01 expressed by the Superintendent and the order of entry for 24.2.2001; contrast that was resolved, after two reminders of the municipal administration, with the only known 04/18/2003 prot. No 5427 of the Superintendence for Architectural Heritage and the countryside of Puglia, and
) a request for legal advice the lawyer. Mauro Ruffo, on 05/15/2002, request not successful for reasons of incompatibility with the note sent by the legal 15.7.2002 prot. No 7031;
f) the recognition of the insufficient identification, in the drawings of the floor and an "excessive invasion of the public sidewalks with ramps scale" survey which was substantially accepted by the same Lacarbonara that it undertook, with the only 20/05/2002 prot note. No 4702, to pay the fee for occupation of public land;
g) the need to wait for the definition of opinion No appeal of the building permit 28/97 (which gave rise to the whole building) of a proposal by the owners of property bordering on the TAR Puglia, Lecce, defined at first instance by the court ruling 02/26/2003 No 507 of the First Chamber of the TAR Puglia, Sec. Lecce and pending in the State Council;
h) the need to replace, for reasons of incompatibility (as a designer, in the first phase of the building in question), the Technical Manager of the City of Leporano with the only employee on duty at the Office, provided the required qualifications (note 18/02/2004 prot. No 2276 of the Mayor of Leporano)
i) the definition of proceedings, on 04/05/2004, with the release of the building permit application required by 27/12/2001; permission to build that drew specifically, among its requirements, the aforementioned note 04/18/2003 prot. No 5427 of the Superintendence for Architectural Heritage and the Landscape of Puglia and the ruling of the First Chamber of the TAR, given on the appeal submitted by the owners of the property borders. The Tar
added that the claimant would still be rejected for a number of issues relating to proof of damages. The appellant Vito
Lacarbonara challenged these rulings, arguing that the evidence retrieved from the Tar are not such as to exclude the fault of the administration and in any case do not justify the delay in issuing the permit to build in variation after the period February to May 2002, when the investigation was now complete.
According to the appellant, also in relation to injury and causal link with the conduct of the administration omission would be provided with sufficient evidence, constituting at least a prima facie evidence.
It is noted that in the first place must be addressed the issue of delays caused by the municipal administration and guilt, which - according to the applicant - to characterize the delay.
The Court of First Instance confirmed the existence of a delay in issuing the permit to build in variant calling - in order to exclude the subjective element of the offense - a number of factors, some of which relate to the incompleteness of the documentation for investigating failures occurred due to the applicant.
It is noted that in the application for permit to build in variation was made on 27 December 2001 and 75 days for the definition of that, attracted by the Tar, expired in March 2002. The same
Tar acknowledges that drawings and opinion of the Superintendent were acquired on February 22, 2002 and that the request of the documents annexed to the opinion of the Superintendent has been found by the person on April 8, 2002. This
On that date means that the investigation was complete and that certainly at that point in charge of the proceedings would have to submit its proposal within ten days pursuant to art. 4, paragraph 2, of DL 398/1993, conv. ln in 493/1993 and within the next two weeks the qualifying title have been issued pursuant to paragraph 4 of Article. 4 (terms substantially corresponding to those of art. 20 of Presidential Decree No 380/2001, which entered into force definitively on 30 June 2003).

are not capable of justifying the delay requirements of inquiry sent by the city to the Superintendency: the latter had expressed a favorable opinion dated February 18, 2002 and the documents produced by the applicant in April 2002 excluded any doubt about the project in relation to which The opinion was expressed.
not return to that point between the powers of the City reviewing the opinion and requests sent to the Department appear in reality intended to challenge the legality of a profile of the opinion (contrary to the constraint), for which the City has no jurisdiction, and not the contradiction with other acts of the Superintendent, who was absent, as subsequently clarified by the latter.
In any event, any doubt on the opinion issued by the Superintendent could not justify the stagnation of the process, or a series of multiple requests, which were found to be dilatory, but at most would have led to a rapid and direct verification at the same Superintendent, in without which the process could only be brought to a conclusion on the basis of documents, among which there was a favorable opinion of the Superintendent.
Even more obvious is the inability of the other circumstances relied on by the tar in order to justify the delay:
- the request for legal advice the lawyer. Ruffo appare un espediente per non assumere la determinazione finale di un procedimento la cui istruttoria era ormai completa, come dimostra il fatto che alla tardiva comunicazione da parte del legale di ragioni di incompatibilità non è seguito il conferimento ad altro legale dell’incarico di redigere un parere, in realtà non utile ai fini della decisione;
- la necessità del pagamento dell’occupazione del suolo pubblico avrebbe dovuto costituire un mero adempimento preliminare al rilascio del titolo abilitativo, dopo l’accoglimento dell’istanza e non poteva certo condizionare il proseguimento del procedimento (peraltro, l’impegno a pagare la tassa è stato assunto nel maggio 2002, a conferma dell’insussistenza grounds for justification of the delay after that date);

- totally specious - in order to reasons for the delay - turns out to be a need to replace the head of the proceeding as inconsistent, since the issues within the organizational arrangements of the AR and that in any way may affect the fulfillment of the terms of the procedure, as a guarantee of the private and the certainty timing of the administration, since the task of devising measures pa organizational measures to ensure compliance of terms provided by law. (Although it is not clear how the replacement of the controller process can justify such a delay).
from those findings as the delay in issuing the permit to build in variation is attributable to the municipality of subjectively Leporano e come non sussista alcun valido elemento idoneo a escludere la colpa dell’amministrazione per il ritardo.
Anzi dagli atti risulta il rilascio del permesso di costruire in variante sia intervenuto solo dopo la presentazione da parte del ricorrente di un ricorso avverso il silenzio ai sensi dell’allora vigente art. 21-bis della L. Tar e ciò conferma come alcun elemento ostativo sussisteva per il rilascio del provvedimento, avvenuto solo dopo la presentazione del ricorso e con due anni di ritardo (anche seguendo le tesi del Comune, qui comunque non accolte, il ritardo di un anno sarebbe imputabile alla sola esigenza di procedere alla nomina del responsabile del procedimento e tale elemento è indicativo della colpevole inerzia tenuta dal comune in questa vicenda).
3. L’accertamento della sussistenza di un ritardo di due anni nel rilascio del permesso di costruire in variante e l’imputabilità del ritardo al Comune non risolvono tutte le problematiche della presente controversia, che attiene al risarcimento del danno subito dal ricorrente a causa di tale ritardo.
Nel caso di specie, ricorre l’ipotesi in cui il privato invoca la tutela risarcitoria per i danni conseguenti al ritardo con cui l'amministrazione ha adottato un provvedimento a lui favorevole, ma emanato appunto con ritardo rispetto al termine previsto per quel determinato procedimento.
Il ritardo procedimentale ha, quindi, determinato un ritardo nell’attribuzione del c.d. "bene della vita", costituito in this case the possibility of building according to the project requested variant.

The rule requires that the time is good for life the citizen and the courts have recognized that the delay in the conclusion of any proceedings, it is always a cost, since the time factor is an essential variable in the preparation and implementation of financial plans relating to any intervention, influencing its convenience economic (cons. Right. Adm. Reg. Sic., November 4, 2010 1368, which, drawing from the arguments cited art. 2-bis, added that the damage is still available even if the authorization process had not yet concluded, even if the outcome had been negative in case).
In this case, it is irrelevant to the question of the Recoverability of damage caused by delay if not attributable to the so-called "good life" and compatibility with the principles established by the plenary session Decision No 7 / 2005 with the new art. 2-bis of Law 241/90, since the administration itself acknowledged that attributable to the (late) permit to build in variant
We must therefore move on to the evidence of the existence of damage and causation to the aforementioned delay. For each hypothesis
pa responsibility for damage caused by the unlawful exercise (or, as in this case, non-exercise) of administration, rests on the applicant in a rigorous proof of the damage, no being able to invoke the so-called principle acquisitive because this principle relates to the conduct of the investigation and the Annex of the facts, even if you may allow the use of rebuttable presumptions art. 2729 cc to prove the damage and its size, it is the inescapable obligation to submit the facts of the subject and when the burden of pleading and proof of the facts there can not be given entry to fulfill equitable assessment of the damage art. 1226 cc, because this rule presupposes the impossibility of proving the precise amount of the injury, nor can it be relied on one expert witness, intended to compensate for the failure to meet the burden of proof by the privato (Cons. Stato,. V, 13 giugno 2008 n. 2967; VI, 12 marzo 2004, n. 1261, secondo cui la consulenza tecnica, pur disposta d'ufficio, non è certo destinata ad esonerare la parte dalla prova dei fatti dalla stessa dedotti e posti a base delle proprie richieste, fatti che devono essere dimostrati dalla medesima parte alla stregua dei criteri di ripartizione dell'onere della prova posti dall'art. 2697 c.c., ma ha la funzione di fornire all'attività valutativa del giudice l'apporto di cognizioni tecniche non possedute).
La stessa richiamata giurisprudenza ha anche precisato che l'onere probatorio può ritenersi assolto allorché il ricorrente indichi, a fronte di un danno certo nella sua verificazione, taluni criteri di quantificazione thereof, unless the court's power to examine the shareability through the contribution of the consultant or engineer, however, when the applicant furnishes proof of the existence and amount of damages.

It is noted that in fact the applicant had lodged in the first instance a series of direct evidence to demonstrate that they damage and causation (report on the overall value of the property, financial statements showing losses and expertise to the part about the biological damage suffered as a result of the prolonged delay of the administration).
The burden of proof was therefore at least partly fulfilled by the applicant, who had provided evidence to demonstrate the delay is attributable to a series of financial losses incurred, and to a medical condition found
This section has therefore set up two expert witnesses to verify the correctness of the applicant's argument, asking, for the profile inherent in the delay in signing contracts, a number of factors capable of identifying criteria di quantificazione diversi da quelli prospettati dalla parte e ciò ha giustificato l’acquisizione in appello di documenti ulteriori, ritenuti indispensabili ai fini della decisione ai sensi dell’art. 104, comma 2, cod. proc. amm. (e, in precedenza, dell’art. 345, comma 3, c.p.c.), tenuto anche conto che tali profili non erano stati approfonditi in primo grado, essendosi il Tar limitato ad escludere la sussistenza dell’elemento soggettivo dell’illecito.
4. Si deve, quindi, passare ad esaminare i due distinti profili della richiesta di risarcimento del danno, partendo da quello inerente il ritardo nella stipula dei contratti di compravendita delle unità immobiliari, oggetto del permesso di costruire in variante in questione.
Sgombrato in precedenza il campo da ogni eccezione relativa alla inammissibilità delle produzioni documentali, avvenute in appello ed esaminate dal Ctu, si rileva come il consulente d’ufficio, dott. Donato Pezzuto, abbia risposto in modo esaustivo ai quesiti formulati, fornendo al Collegio ogni elemento per decidere, anche in relazione alle osservazioni formulate dai consulenti di parte.
In particolare, con riferimento all’incidenza del ritardo nel rilascio del permesso di costruire sul prezzo di compravendita, risultante dai contratti definitivi, il Ctu ha evidenziato che non sono documentate le ragioni per cui le parti abbiano stipulato i contratti definitivi ad un prezzo inferiore a quello indicato sui preliminari di vendita, adding that the possibility of damage on these price differences is based solely on the statements and that part of the preliminary contracts are not registered with the Inland Revenue and they have no firm date.
The consultant was right to put the assessment of such items to the State Council, while quantifying the price differences between preliminary and final contracts in euro 332,904.90.
The Board believes that has not been reached adequate proof of date of signing of the preliminaries and, above all, the causal link between the delay in issuing the permit to construct and different price quoted in the final acts of sale.
Any suitable element was provided by applicant to show that these differences represent a discount applied as a result of the delay in signing the final contracts and must, therefore, ruled out the existence of the mentioned causality.
The CTU has also stated that, although not shown in most of the contracts a preliminary date for the signing of definitive, it is reasonable to assume that if the variation had been granted permission in a timely manner, the final contracts could be awarded to Since the end of May 2002.
That finding, the Board agrees, takes a view that there is a causal link between the delay of the City and the damage caused by failure Immediate availability the amounts corresponding to the purchase price of the property for the applicant.
In order to quantify the damage, the consultant has proposed two alternative criteria, one is the interest actually charged by the bank to the claimant and the second based on the statutory interest. The Board considers
not likely that no small amount of money could be left by the applicant on his bank account, which by then had very low interest (below 0.1%) and judges, therefore, proper use of the criterion of legal interest, in which period ranging between 2.5 and 3% (corresponding to different extent other forms of investment, easily accessible).
This policy has been correctly applied by the consultant in relation to the date of each exchange transaction, just as properly excluding those operations for which was concluded after a preliminary permit to build in variation.
The total amount of statutory interest, calculated by the consultant, is the sum of € 36,100.33 and must therefore be granted to the applicant under dir damages, together with the further sum of € 2042.48, corresponding to the interests and expenses for financing by the applicant contract with a bank in June 2002, which would not have been contracted or would have been immediately terminated in case of absence of the delay and consequent early availability of funds stemming from the sale of the properties.
E 'also proved a causal link between the late issuance of building permits and the subsequent signing of final contracts and ICE, the applicant continued to pay for the period May 2002 to May 2004 amounted to euro 2117 , 36 (who would not pay if the contracts are concluded before the final).
With reference to the legal costs claimed by the applicant, it is noted that expenses related to judgments against the town of Leporano counterparties or against others over the issue of the building permit can not be recognized in this office for compensation, ma formeranno oggetto delle statuizione dei competenti giudici in sede di definizione di ciascuna controversia (compresa ovviamente la presente, come verrà statuito in seguito).
Vanno, invece, riconosciute a titolo di risarcimento del danno le spese sostenute nella causa promossa dal signor Valentini contro il ricorrente proprio per il ritardo nella stipula del contratto definitivo e per una riduzione del prezzo; tali spese ammontano a euro 3.864,86.
In relazione a tale controversia non può essere riconosciuta alcuna ulteriore somma a titolo di risarcimento del danno, non essendovi allo stato un danno certo e dipendendo l’attualità della questione dall’esito di quel giudizio civile, trattandosi, allo stato, di un danno puramente hypothetical and not supported by any evidence - as correctly stated by Tar - the reasonable likelihood of verification.
