gives the following
DECISION
on appeal No 9398/00 Reg Gen., proposed by Mr. Silverio Mazzella, represented and defended by the lawyer. Adriano box and at the same address for service in Rome, Viale Regina Margherita 290;
AGAINST
the town of Formia, in the person of the mayor in office, actually represented and defended by the lawyer. Giampiero Amorelli and at the same address for service in Rome, Via dei Mille No 41 / A;
for the reform of the Judgement No 19 April 2000 210 of the Lazio Regional Administrative Court, a branch of Latin America, made between the parties.
Since the action with its annexes;

The facts and law considered in the following: FACT
By application of appeal served on 27 September to 4 October 2000 and filed on 25 following Mr. Mazzella Silverio explained that by decision of 7 September 1989 n . 531 Council of State, Section V, confirms the decision No 15 April 1988 250 of the TAR Lazio, Latina section, had been established the existence of civil service by 21 June 1969 between the same Mr. Mazzella, set the Conciliation and Formia, as to claims to property, was declared the prescription of those from 1969 to 1972 of el'inammissibilità those up to 30 June 1978, while for the period after the said Municipality was ordered to pay the wage difference, interest and currency appreciation. Il TAR ha però respinto tale ricorso con sentenza 19 aprile 2000 n. 210, gravata in questa sede.

A sostengo dell’appello ha dedotto:

1.- Il TAR ha ritenuto che l’azione non sarebbe esperibile per la stessa pretesa dichiarata prescritta e inammissibile, aggiungendo che in ogni caso mancherebbe la prova della diminuzione patrimoniale.

2.- In tal modo il TAR non ha tenuto presente la diversità tra le due azioni e, nel contempo, che la prova della diminuzione patrimoniale è stata fornita con l’espresso riferimento allo stipendio che il ricorrente ha percepito per le stesse funzioni nell’ambito dello stesso rapporto d’impiego nel periodo non prescritto.

All’odierna udienza pubblica l’appello è stato posto in decisione.
D I R I T T O
Com’è esposto nella narrativa che precede, la questione sottoposta all’esame della Sezione concerne differenze retributive, rivendicate dall’attuale appellante signor Silverio Mazzella mediante l’azione di arricchimento senza causa di cui all’art. 2041 cod. civ., aumentate appreciation for and interest relating to the period from June 21, 1969 (commencement of legal employment relationship with the City of forms such as municipal messenger, whose existence has been confirmed by 7 September 1989 Decision No 531 of this section) to September 30 1978 (economic effect of the ratio), during which he represents have not received his salary corresponding to that of non-tenured municipal employee with similar qualifications and duties, but remains below the following annual contracts.

The same appellant states that similar property claims, advanced in the ascertainment of the ratio of direct employment in the employ of Formia, were declared partly inadmissible and partly prescribed.

The Court of First Instance found the experienced action of unjust enrichment is not feasible, since excluded from abstract possibility to satisfy the claims in question with a specific action, in reality unsuccessfully performed, as well as unfounded, the absence of evidence of effective Capital reduction suffered.

Here Mr. Mazzella complains, as regards the first point, that the TAR has ignored for that period, as has been recognized, however, the legal title that would not now entitled to the same action (for recovery of back wages), but the new and separate action sussidiaria ex art. 2041 cod. civ., avendo comunque la pubblica amministrazione utilizzato le proprie prestazioni senza corrispondergli la retribuzione dovuta al dipendente comunale con le stesse funzioni. E, in ordine al secondo profilo, di aver invece fornito la prova predetta mediante l’espresso riferimento al documentato stipendio che egli ha poi percepito per le stesse funzioni, nell’ambito dello stesso rapporto e con riguardo al periodo non prescritto.

L’appello è infondato poiché la pronuncia appellata merita piena conferma.

Ai sensi dell’art. 2042 cod. civ., l’azione di arricchimento senza causa prevista dall’articolo precedente ha "carattere sussidiario", ossia "non è feasible when the injured person may have another action to get the injury compensation.

Oltretutto, la svolta domanda era da ritenersi in ogni caso infondata in relazione all’omessa dimostrazione di un impoverimento subito per effetto dell’arricchimento dell’altro soggetto, impoverimento che è altra cosa rispetto al mancato incremento patrimoniale (cfr. Cons. St., sez. V, 3 ottobre 2002 n. 5209, nonché sez. IV, 6 agosto 2005 n. 4171 e Sez. 5 dicembre 2006 n. 7118).

St., sect. IV, 15 July 2008 No 3564).

In conclusion, the appeal must be dismissed. However, reasons of equity between the parties to advise the compensation of the costs of this degree.

FACT

The decision under appeal as inadmissible the action brought by the appellant, for the annulment of the resolution of the Board City of Occhiobello No 32, March 30, 2006, the resolution of the Town Council No 94, May 30, 2006, determining the responsible Administrative Area No 20, May 31, 2006.
The appellant challenges the imposition of inadmissibility and repeats the criticisms are not considered by the court. The town stands to appeal, while other parties have not made in court.
LAW

The appellant challenges the imposition of inadmissibility of the appeal, arguing, first, that the contested measures are null and void under Article 21-f of Law 241/1990, for lack of the object. Article 21 of Law n-f . 241/1990, introduced by Law No 15/2005, consolidated the conceptual category of administrative decision null and void.
The rule states, in summary, the hypothesis of nullity, including in cases of a lack of essential provisions.
In the absence of an explicit legislative statement of the essential elements of the measure, it is possible to develop an interpretive reading of the provision, modeled on the concepts of substantive civil branch, concerning contracts and legal transactions.
In this perspective, then, is to correct the general approach followed by the appellant, that the object of the measure is one of the essential elements of the act and its possible absence determines the invalidity of the measure.
Nor does the object the administrative order is explicitly defined by law. Even in civil law perspective, then, the general category of the object of the contract is not specified in the legislative and, by interpretation, it is outlined very different theoretical perspectives.
Without analyzing in detail the various theses proposed, it is preferable to the review, followed by the prevailing case law, that the object indicates the portion of the legal and material reality on which the act is intended to affect.
Therefore, in this case, the application made by the company should be classified as a deductible item to the lack of measures claims.
These clearly indicate their reference objects in the service of local, qualified as an addition. The lack of any substantial basis, represented, in the opinion of the appellant, the identification within the framework of regional planning, would, if proved, the illegality of the acts for violation of the law (to assert the ordinary deadline decadenziale) and not the invalidity of the measures for alleged failure to object
their second plea, the appellant submits that the Board resolution No. 32/1996 "is divided into two events: an actual and a merely intentional provvedimentale e/o di direttiva interna".
La parte provvedimentale riguarderebbe la conferma del servizio di trasporto pubblico urbano. Viceversa, la parte meramente programmatica si riferirebbe alla decisione riguardante l’indizione della gara per l’affidamento del servizio.
La determinazione provvedimentale riguardante la gara si concentra, invece, nella delibera della giunta municipale n. 94/2006, la quale determina i contenuti e i requisiti specifici della gara.
Pertanto, l’eventuale tardività dell’impugnazione della deliberazione consiliare n. 32/2006 non inciderebbe sulla tempestività del ricorso proposto contro la delibera di Giunta n. 94/2006. Quest’ultima non potrebbe essere qualificata come atto meramente esecutivo, considerando la sua autonoma valenza provvedimentale.
Il motivo è infondato.
La delibera di giunta n. 94/2006 e la determinazione dirigenziale n. 20/2006 contengono nuovi effetti provvedimentali, i quali non sono riconducibili alla mera esecuzione della deliberazione consiliare, ma risultano riferiti alle modalità di svolgimento della gara.
Tuttavia, va considerato che le censure proposte dall’appellante riguardano, esplicitamente, la sola decisione dell’amministrazione comunale di istituire un servizio di trasporto pubblico in una tratta interessata dall’attività della società interessata.
Pertanto, la lesione lamentata si riferisce, indiscutibilmente, alla prima parte ("provvedimentale") della delibera consiliare impugnata.
In definitiva, quindi, l’appello deve essere respinto, con la conferma della pronuncia di irricevibilità del ricorso proposto in primo grado.
Le spese possono essere compensate.
Per Questi Motivi
Il Consiglio di Stato in sede giurisdizionale, Sezione Quinta, respinge l'appello, compensando le spese;
ordina che la presente decisione sia eseguita dall'Autorità amministrativa.

The book opens with the Preface (p. 7) of Cardinal Dario Castrillon Hoyos, president of the Pontifical Commission Ecclesia Dei, which, recalling the full legitimacy of a liturgy which for centuries has nourished the spirituality of many saints, says that "it is possible to consider that the ancient rite expresses better the meaning of Christ's sacrifice that is represented in every Mass" (ibid.). In the Introduction (pp. 9-12) the authors point out quite rightly as the mail at stake goes beyond the strictly liturgical, to bind to the broader question of the correct reception of Vatican II (1962-1965) and teaching in general. The subject is taken in the first chapter, the liturgy (pp. 13-27), highlighting the continuity of Vatican II with the previous teaching, even in the liturgy. However, at the hands of a minority has spread throughout the mistaken idea that the council would represent an "absolute novelty, the prelude of a new Christianity" (p. 22), liturgical abuses to be confused with the liturgical reform, even taking a the latter a pretext for the ideological struggle with the past. Il terzo capitolo è dedicato ai Ministri della liturgia (pp. 45-64), istituiti da Gesù Cristo «affinché fosse predicata la verità, venissero rimessi i peccati, scacciato il male e celebrata la Messa, rinnovazione sacramentale del Sacrificio della Croce» (p. 46). Although they used in the early centuries, it is proper liturgical vestments, "it is easy and logical to assume that the clothes are not used to the altar they used in other daily activities" (p. 65), but in any case in the sixth century, the distinction between secular dress and liturgical dress also visible in the mosaics of San Vitale in Ravenna. After the short seventh chapter - The Liturgical Year (p. 101) - the eighth in detail the Mass (p. 103-113), enriching the clear exposition of the most "technical" - such as differences read between the Mass, sung, solemn, and so on. or the various moments of the ritual - with "some consideration to fully live the most sublime of Miracles" (p. 105) - che può risultare utile per comprendere meglio anche le corrispondenti fasi della Messa nella forma ordinaria. Con il nono capitolo - The solemn Vespers (pp. 115-116) - concludes this long section "Getting Started" and begins the tenth and last one is the service of the Mass (pp. 117-266). fact and law
1. By notice dated 31 July 2002, the municipality of Florence called for a race win by the criterion of the lowest price for completion of work to complete the South Hall of the Center for Contemporary Art - Lot II -. As
of interest for the present case, the notice stated that the administration has made the evaluation and possible exclusion of tenders found to be abnormal based on the method of calculation laid down in Article. 21, par. 1 a, LN 109 of 1994 for this purpose offers should have been accompanied, when submitted, by justifications be provided at least on the basis for drawing called "People work done" in any case, it was stated that in compliance with European requirements, there remained the possibility of a firm following contradictory and production by competitors, or at the request of 'Directors, the justification of any kind deemed relevant to demonstrate the adequacy of supply.
1.1. During the race it was detected the anomaly threshold to 22.77%, inter alios, the deals are suspect of the following companies:
Romagnoli spa - in person and as an agent of the car with the CTC Consorzio Toscano Construction - (already allotted to its the first time lot of work to be completed), later transformed into the Manufacturers Pisa SpA (Pisa), with a fall of 22.87%;
Spinosa Costruzioni Generali srl (hereinafter Spinosa), with a fall of 24.50%;
Saceda Ltd., with a fall of 28.63.
1.2. Upon completion of an initial review of the anomaly is immune only offer Pisa.
With No Judgement 5479 of 27 October 2003 for the Tar Tuscany declared inadmissible an appeal brought by Spinosa first trial against the anomalies of their bids.
With No Judgement 5478 of 27 October 2003, the same Tar welcomed the action brought by Saceda Ltd and quashed any stage of the verification process of anomaly delle offerte per la difettosa costituzione dell’organo chiamato a valutarle.
1.3. Il nuovo gruppo di lavoro costituito dal comune di Firenze rinnovò il procedimento di anomalia pervenendo alle medesime conclusioni, sicché in data 1 aprile 2004 la gara fu aggiudicata in via provvisoria alla ditta Pisa.
1.4. Con ricorso rubricato al nrg. 1167/2004 e successivi motivi aggiunti, la società Spinosa aggredì il giudizio di anomalia della propria offerta (ed in via derivata anche l’aggiudicazione provvisoria e definitiva della gara), lamentando nella sostanza:
la violazione del principio del contraddittorio, avendo reso giustificazioni su elementi che poi non erano stati effettivamente considerati dalla stazione appaltante in court of problem
the validity of the evidence deemed unreliable by the price because of the date of submission of tenders,
the disparity in treatment by the test in assessing the reasons for the Pisa and those made from it applicant.
During the trial the Tar granted the protective order request by ordering the administration to make a further check, for counter-bid at Spinosa (see Ordinance No. 717 of June 29, 2004).
Even at the end of this further procedural the contracting activity confirmed the finding of failure to supply Spinosa, which was forced to articulate additional grounds. The Tar
, always in the action brought by Spinosa, ctu ordered to ascertain the reasonableness of the work the body responsible for the anomaly.
1.5. Nrg entitled to an appeal. 1210/2004 Ingg society. Provera & Careers SpA (Provera), which had submitted a bid not exuberant the anomaly threshold, has challenged the award made in favor of Pisa company claiming that its tender was excluded for failure.
1.6. Nrg entitled to an appeal. 2275/2004 Saceda the company, in turn, sought the annulment of both the their exclusion that the proceedings do not offer fault of Pisa.
2. The contested decision - Tar for Tuscany, Section Two, No 825 of June 4, 2007 -:
brought together the three actions of First Instance;
considered it a priority to examine the action brought by Spinosa, on the assumption that the eventual acceptance of that would extend its beneficial effects also against two other actions (paragraphs 3 and 21 beds. d);
considered unlawful exclusion for anomaly Spinosa, also on the basis of information provided by the CTU, accepting its application;
upheld the claim for compensation in the form specifically formulated dalla Spinosa, limitatamente all’obbligo per l’amministrazione di rinnovare, con esito libero, il procedimento di verifica di anomalia;
ha dichiarato improcedibili per sopravenuta carenza di interesse i ricorsi proposti dalle Imprese Provera e Saced (tale capo non è stato impugnato);
ha condannato il comune di Firenze al pagamento delle spese di lite e di c.t.u. in favore della Spinosa (anche tale capo non è stato impugnato).
3. Con ricorso rubricato al nrg. 9246/2007 - notificato il 14 e 15 novembre 2007, e depositato il successivo 26 novembre - la società Pisa ha interposto appello avverso la su menzionata sentenza del T.a.r. deducendo:
con il primo motivo, violazione dell’art. 21, comma 1 a, ln 109, 1994; violation of Article. 30 of Directive 37/1993; incorrect and contradictory reasoning and evaluation of conditions, failure to rule on crucial issues, breach of Article. 15, 145, 2000 dmn;
with the second reason, disregard for the judicial review, defect, incorrect and contradictory reasoning, incorrect assessment of the conditions;
with the third reason, contrary to Article. 112 CPC, the principle of correspondence between requested and delivered, breach of the adversarial principle, violation of Article. 21, LN 109 of 1994; incorrect assessment of the conditions, defects and erroneous motivation.
4. It consists of the company Spinosa deducting the appeal unfounded in fact and law.
5. By application starts for the postal service, art. 1, ln 53, 1994, 18 and 20 November 2007, and filed on November 21, the company Spinosa, in turn, appealed - headed to nrg. 9088/2007 - minus:
with the first reason, the effects of accepting unlawful extension of its appeal to companies and Saceda Provera despite the declaration of admissibility of the liens, proposed by them;
the second ground, the condemnation of the town of Florence to compensation in the form specified by the award direct challenge in the race;
with the third reason, finally, an order of the municipality to pay damages for monetary equivalent, related to the non-profit business and the loss of chance.
6. In its opinion is not formed any of the private parts.
7. The causes are spent in the decision of December 5, 2008 public hearing.
8. The appeals brought against the same sentence, should be convened at the artist's mind. 335 cpc
9. Outset to be rejected except for lateness and admissibility of appeal brought by Spinosa, cherished the memory of society Pisa, 24 November 2008, as an alternative to meeting deals with appeals.
The exception is based on the crucial assumption that this would appeal form and substance of a cross-appeal. The thesis is
inaccoglibile.
The appeal brought by Spinosa, in fact, be classified as incidental because it is aimed at challenging quasi autonomous leaders of the contested decision and, therefore, supported by self-interest in challenging principaliter.
While in the administrative process is applied art. 333 Code, under which the party has been notified that the main appeal must in turn present their grievances in the same process as a preliminary issue - in order to achieve simultaneus processus - it is also true that individuata la forma del secondo gravame, occorre analizzarne il contenuto sostanziale per l'individuazione della disciplina applicabile. Sicché ove questo, come nel caso di specie, si risolva non in una mera controimpugnazione su capi dipendenti o connessi da quelli contrastati principaliter, ma abbia ad oggetto doglianze autonome ed indipendenti, sarà soggetto ai termini ordinari per l'impugnazione previsti dall'art. 28, l. 6 dicembre 1971, n. 1034 e 327 c.p.c. (cfr. da ultimo Cons. St., sez. IV, 7 settembre 2006, n. 5196).
Nella specie il gravame incidentale improprio è stato ritualmente notificato e depositato.
In ogni caso, anche a voler considerare il gravame della Spinosa quale appello incidentale proprio, risultano rispettati, in the particular case, the terms of service and storage, according to art. 37, Royal Decree No. 1054 of 1924, although half the art. 23a, l. Tar, respectively at 15 and 5 days.
10. In the first half the company claims Pisa, in substance, that the justifications given in the sub process of the event, can not be later than the date of submission of the original, well below that angle would make the the contracting authority to consider unacceptable, and those made by Spinosa, in general, unreliable supply of the latter.
The plea is unfounded.
The system of Community rules (as interpreted dalla Corte di giustizia nella sentenza 27 novembre 2001, n. 285 e dalla giurisprudenza nazionale, cfr. ex plurimis Cons. St., sez. IV, 7 giugno 2004, n. 3554), anche antecedentemente alle direttive 17 e 18 del 2004 ed al codice degli appalti (d.lvo n. 163 del 2006) che le ha recepite (inapplicabile ratione temporis), non si oppone a che l’amministrazione richieda a pena di esclusione che le offerte presentate siano corredate da giustificazioni preventive anche in misura inferiore al 100%, purché sia garantita una effettiva fase di valutazione in contraddittorio, successivamente all’apertura delle buste.
Il principio, per essere attuato in modo pienamente conforme al sistema comunitario, va temperato con alcune precisazioni:

Cons. St., sez. IV, 7 giugno 2004, n. 3554);
L’integrazione delle giustificazioni originarie a mezzo di ulteriore produzione documentale, costituendo applicazione del principio comunitario del contraddittorio successivo, implica un fisiologico arricchimento degli elementi dedotti in origine, senza che la stazione appaltante possa dedurre il carattere nuovo ed ulteriore della documentazione rispetto a quella esibita in origine, con il limite, però, del divieto dello stravolgimento dell’offerta originaria, che non può trasformarsi, per il tramite delle seconde giustificazioni, in un quid di sostanzialmente nuovo o diverso (cfr. Cons. St., sez. IV, 7 giugno 2004, n. 3554).
Nel caso di specie, come risulta dall’esame di tutta la documentazione versata in atti, deve escludersi che le giustificazioni, ritenute inattendibili dal saggio di gara, alterassero gli elementi costitutivi dell’offerta.
Devono essere pertanto respinte tutte le censure articolate dalla società Pisa da pagina 22 a pagina 48 dell’atto di gravame.
Tali doglianze sono infondate, alla luce delle risultanze istruttorie, anche nella parte in cui contestano la fornitura dei diaframmi, della bentonite, degli impianti elettrici nonché la consistenza della riserva economica elaborata dalla Spinosa.

10.1. By the second half, the company argues that the court would Pisa DeCamp bounds della giurisdizione di legittimità sostituendo la propria valutazione (e quella del c.t.u. definito ignoto ingegnere di Lucca) a quella della stazione appaltante.
Il mezzo è infondato.
In primo luogo giova precisare che il c.t.u. è (o almeno era all’epoca dei fatti) il capo dell’Ufficio tecnico comunale del comune di Lucca, professionista dunque munito di specifiche competenze settoriali.
In ogni caso la tesi propugnata dall’appellante è smentita dalla piana lettura dell’impugnata sentenza.
Il T.a.r. non si è affatto sostituito alle valutazioni tecnico discrezionali appannaggio del seggio di gara, ma le ha confutate ab externo, mettendo in luce la loro manifesta illogicità ed irregolarità formal.

The plea is unfounded. The Tar
entrusted to ctu relevant technical investigation on the fairness of the offer made by the Pisa for the sole purpose of deciding the merits of the complaint of unequal treatment raised Spinosa by the company, once regarded as established the diversity of the yardstick used by the seat of the race, was careful not to fault the cancellation proceedings issued by that body in respect of the offer was in the end awarded the contract.
There is therefore irrelevant, and in any case unfounded on the basis of technical data on the file in the office, the complaints moved by the appellant (from page 62 to page 69 of application), the assumption that the ruling would not set aside the proceedings of anomaly of the tenderer.
11. Can go down now examine the appeal brought by Spinosa.
11.1. In the first half criticizing arguments sviluppate ai punti 3 e 21 lett. d) dell’impugnata sentenza nella parte in cui estendono gli effetti conformativi favorevoli della pronuncia alle imprese Saced e Provera, facendone discendere l’obbligo per la stazione appaltante di sottoporre a nuovo procedimento di anomalia tutte e tre le offerte (Spinosa, Saced e Provera) e conseguentemente l’improcedibilità dei rispettivi ricorsi proposti dalle ultime due.
Il mezzo è fondato.
Sebbene le società Saced e Provera non abbiano formulato appello sul capo della sentenza che ha dichiarato improcedibili i rispettivi ricorsi, ciò nonostante è evidente l’interesse della Spinosa a rimuovere il punto ad essa sfavorevole che pregiudica in via immediata e diretta l’eventuale riesercizio future of power by the awarding entity. Provera had not exceeded the alert threshold of anomaly and thus in no way should have been submitted to its verification process in the implementation of any final;
society Provera sought the annulment of the final only on the assumption of the illegality of the lack of exclusion for failure of supply Pisa, but the question that has supported the use of First Instance of Provera, as previously noted, has never been tested, the
Saceda not ranked behind Spinosa, but rather in a downward position by offering more poziore ;
Spinosa has never asked for the cancellation of the anomaly of non-exclusion provision of Pisa, it is clear on this point, the lack of specific interest to take action to have offered the lowest price.
ultimately can not be argued that the annulment of the award has been given to the unlawful exclusion of non supply fault Pisa, and the Tar, the specific location considered in modo anodino che < > (punto 21 lett.c); deve ribadirsi, però, che la ditta Spinosa ha lamentato la concessività del metro di giudizio utilizzato dalla stazione appaltante per valutare l’offerta Pisa al solo scopo di suffragare la censura di eccesso di potere per disparità di trattamento, mossa in funzione dell’annullamento della propria esclusione e non della mancata esclusione della Pisa.
Per completezza il collegio dà atto che la difesa della società Pisa non ha contestato l’accoglimento del mezzo di gravame in trattazione (pagina 5 memoria conclusionale del 24 novembre 2008).
11.2. Quanto al secondo mezzo di gravame la sezione osserva che è sicuramente inammissibile la domanda di risarcimento the damage in a specific form by direct award of the race, based on the recently developed arguments from meeting of this Council to the Plenary that the section does not intend to depart (see decisions of 21 November 2008, 12 and 30 July 2008, No 9).
11.3. Inaccoglibile is also the question of compensation equivalent to the monetary damages resulting from lost profits and lost business opportunity.
The College does not intend to deviate from the address on the point of case law that excludes the possibility of evaluating the merits of the claim for damages when the measure excluding anomaly is canceled, as is the case, for formal and procedural defects that allow the riesercizio of power by the contracting (see Cons. St., sect. VI, June 30, 2006, No. 4231, sect. IV, May 20, 2003, No. 2708, sect. VI, 4 September 2002 No. 4435).
12. In conclusion should be rejected in its entirety the appeal by the company Pisa, while that of Spinosa society must be allowed to change only in the sense just now stated, that judgment's reasoning remains unchanged in the rest. In the reciprocal
Party, the loser sees good reasons to fully compensate between them the costs of these proceedings.

The Council of State in the courts (Section Five), definitively ruling on the actions together serve best as an epigraph:
- reject the appeal filed by the Company Pisa Spa Builders - Romagnoli successor to the spa - in person and as an agent of the car with the CTC Consorzio Toscano Construction;
- accept in part, pursuant to and within the limits of the reasons given, the appeal filed by Spinosa Costruzioni Generali srl and the effect of confirming the decision under appeal for different reasons;
- declared by the parties fully offset the costs of these trial.

Con sentenza n. 1353/2000 del TAR Sicilia, Sezione staccata di Catania, II sez., passata in giudicato, sono stati decisi i tre ricorsi sopraindicati e annullati i provvedimenti impugnati, compresa la dichiarazione di pubblica utilità di cui alla delibera di Giunta n. 2509 del 31.10.1989.
Con il ricorso introduttivo deciso dalla sentenza oggetto di impugnazione, l’appellante, rilevato che il suolo era stato utilizzato per la realizzazione della strada nonostante l’intervenuto annullamento della dichiarazione di pubblica utilità e degli altri provvedimenti chiedeva il risarcimento del danno.
La sentenza impugnata, in accoglimento parziale del ricorso ha condannato l’amministrazione comunale al risarcimento del danno lamentato dal ricorrente, conseguente alla utilizzazione del suo fondo, non assistita da valido titolo.
L’appellante contesta il capo della sentenza riguardante la determinazione della misura del risarcimento del danno.
Il comune resiste al gravame.
D I R I T T O
L’amministrazione comunale, con la propria memoria difensiva, deduce, in primo luogo, il difetto di giurisdizione del giudice amministrativo.
Il Collegio osserva, al riguardo, che sulla questione della giurisdizione si è formato il "giudicato implicito", conseguente all’accogli-mento, nel merito, delle domande proposte in primo grado dal ricorrente (Cfr. Cassazione, Sezioni United No 2483/2008), because the administration did not challenge the ritual head of the ruling unfavorable to it, merely the prospect of its argument with a simple memory, not even notified the other party.

The administrative jurisdiction on the case, then, is rooted in Article 7 of the Act and Article 35 of the TAR Legislative Decree 80/1998 (knowledge of claims for damages "consequential", even before Article 53 of the Consolidated expropriation and Article 34 of Legislative Decree No. 80/1998 (Civil Cassation, sez. A., April 19, 2007 , No. 9324, Civil Court of Cassation, sez. a., February 19, 2007, n. 3725).
The Board notes, moreover, that the Administration has made no objection to the ruling appealed the ruling to the effect that the applicant First Instance has retained the right to ownership of the property until the commencement of the application for compensation equivalent to: at that time, withdraw his application for restitution of the property, the person concerned abandoned its right to property, sells the Property in favor of the administration, notwithstanding its right to damages.

The ruling upheld the respondent for damages, performing the following reasons.
"For the purposes of assessment of damages, it should be noted that following the ruling of the Constitutional Court, by decision No. 349 of 24.10.2007, which declared the unconstitutionality of Article. 5-bis, paragraph 7-bis of the Decree-Law of 11 July 1992, No. 333 (Urgent measures for the consolidation of public finances) - ratified with amendments by Law 8 August 1992, No. 359 - added by paragraph. 3, paragraph 65 of Law 23 December 1996, No. 662 (Measures to rationalize public finances), because "by failing to provide a rest for full damage suffered as a result of employment by the acquisitive public administration, corresponding to the market value of the property occupied, is in conflict with international obligations laid down by 'Art. 1 of the Additional Protocol to the ECHR and thereby violates Article. 117, first paragraph of the Constitution. ", the damage suffered by the applicant must be settled taking into account the market value of that fund on the date of completion of the work , occurs when the disposal of the right dominicale by the individual who has opted for compensation. Finally, in the course of writing the grounds of the intervened, the rule contained in the Budget Law for 2008, l. 24/12/2007 No 244, Article. 2, paragraph 89, read. e) provides: Article 55 (Legislative Decree No. 327 of 8 .6.2001), paragraph 1 is replaced by the following:
"1. In the case of leasing of land for building purposes in the public interest, in the absence of valid and effective measure of expropriation on 30 September 1996, liquidated damages will be paid an amount equal to fair market value of the property. "
The City is ordered to compensate the damage in question, according to this criterion validation, and obviously deducting the amount calculated as the sums already paid, with the caveat that against the decision of liquidation you can resort to this Court for appropriate decisions.
should be noted that the "market value" of the property should be identified, taking into account the average market price for areas of the same type, with the same characteristics of urban growth, falling in the same area. The survey aimed at identifying the prices in the housing market may be drawing on information from the most reliable real estate agencies in the area.
The value so determined shall be, then, subject to increase for currency appreciation and legal interest from the date of calculation until I meet (TAR Lazio IIa, 18.1.2008, 363).
In First, the part of appellant complains that, in determining the market value of the property, should refer to the date of completion of a public which was on the ground. According to him, however, consider the date of enactment of the compulsory acquisition of the property, or, failing that, the filing date of the decision pronouncing the sentence to pay damages or, in the alternative, the date for submitting the application for compensation (leading in this respect, the abdication of the right of private property).
The complaint is well founded, for the reasons described below.
First, it is clear that it does not seem relevant the call, made by the ruling appealed, Article 55 of the Consolidated expropriations. This provision is, arguably, the occupations untitled prior to September 30, 1996. In this case it is undisputed that the employment is commenced 21 December 2001 and that the transformation of the fund has occurred still later (in 2002).
remains, however, agree with the conclusion reached by the court, seeking to assert the principle of the right to full compensation for damages sustained by (expressed by the said Article 55, the text now in force, but also Article 43 of the deduced Consolidated expropriation and case law, including European, recall), although for partly different reasons.
In fact, in this case, it is certainly configurable designs with the possibility of employment, since the assumption of unfailing good and effective declaration of public utility work, at the time of the irreversible transformation of the fund (repeatedly stated by law) and, specifically, poor, just as a result of intervening annulment of the declaration.
In this regard, it should recall the address of the prevailing case law, which "should be excluded from employment appropriative behavior of p.a. non collegati ad alcuna utilità pubblica formalmente dichiarata, o per mancanza "ab initio" della dichiarazione di pubblica utilità o perché questa è venuta meno in seguito ad annullamento dell'atto in cui essa era contenuta o per scadenza dei relativi termini. In tali vicende, definite di occupazione usurpativa, non si produce l'effetto acquisitivo a favore della p.a., donde il proprietario può chiedere la restituzione del fondo occupato o il risarcimento del danno, che deve essere liquidato in misura integrale (fra le tante, Consiglio Stato, sez. VI, 20 maggio 2004, n. 3267).
Nello stesso senso, si è precisato che, ove il giudice amministrativo abbia annullato un atto con valore di dichiarazione di pubblica utilità, l'attività esecutiva dell'amministrazione è qualificabile come mero comportamento materiale e si configura un'occupazione usurpativa; tuttavia la domanda di restituzione dell'area e quella di risarcimento del danno vanno proposte al giudice amministrativo, ai sensi dell'art. 35 d.lg. 31 marzo 1998 n. 80, come modificato dall'art. 7 l. 21 luglio 2000 n. 205, essendo venuta meno la riserva al giudice ordinario dei "diritti consequenziali" (Cassazione civile, sez. un., 19 aprile 2007, n. 9324).
Pertanto, in ipotesi di occupazione usurpativa il risarcimento del danno deve essere commisurato al valore pieno del terreno perduto, stante l'inapplicabilità a tale tipo di occupazione, in relazione al suo carattere abusivo, della l. n. 359, 1992, Art. 5 bis, paragraph 7 bis, to refer exclusively to employment "level", meaning the reference to "illegal occupation of land for the public interest" to express a teleological connection with the aims pursued by the expropriation proceedings (Civil Cassation, sez. Con riferimento all’occupazione appropriativa, la giurisprudenza della Corte di Cassazione aveva prospettato diverse soluzioni interpretative, ancorando il valore del bene, alternativamente, ai seguenti momenti essenziali (salve alcune limitate "varianti", legate alla eventuale peculiarità di singole fattispecie):
a) l’inizio dell’occupazione illegittima;
b) la trasformazione irreversibile del suolo;
c) la proposizione della domanda di risarcimento del danno;
d) la pronuncia della sentenza.
A queste soluzioni potrebbe aggiungersi, ora, sulla base dell’articolo 43 del testo unico delle espropriazioni, il riferimento alla data di inizio della effettiva "utilizzazione per scopi di interesse pubblico", che, secondo una certa linea interpretativa, indicherebbe un momento diverso e successivo rispetto alla materiale trasformazione dell’immobile.
La soluzione prevalente, tuttavia, è stata (ed è tuttora) quella prospettata alla lettera b): determinante è il momento della trasformazione final and not reversible property.

In this perspective, it seems crucial to emphasize that at the same time irreversible transformation occurs even fund the "substantial discharge" of the right of property rights and the improvement of the offense, classified as a flash, with permanent effects. In fact, employment appropriate given the loss of "economic value" of the property goes with each other to settle the law dominicale the asset acquired by the government.
Then, the same interpretive approach does not seem to automatically exported in a regulated directions that no longer provides for the establishment of employment and appropriate links the loss of property for the use of the property without title, for purposes of public interest, the adoption of an appropriate measure of association administration.
A fortiori, this line of argument does not apply in cases of "pirated employment" if there has been the cancellation of the declaration of public utilities and the work has been completed, but not determine - for that reason alone - the extinction property rights concerned.
If the injury for which compensation is essentially the loss of asset value in which substantiates the right of property, the damage must be necessarily related to the economic entity of the asset when the asset is permanently removed from the ownership of private and acquired the assets of the administration.
This time of completion of the work is not public, but that, unlike in the administration adopts a measure of healing acquisition or, failing that, one in which the owner, whichever is only compensation for equivalent , leaves in its right of ownership to the administration.
Neither one could argue that the moment of irreversible transformation of the asset (or that, and different - usually later - the start of the use for public interest purposes) already lead to the consummation of the loss of value of property, emptying all the spaces substantive right.
Even in this situation would remain the firm's right to obtain restitution of the property, with the full re-expansion of power supply to the illegal use of the property, with only general limits of Article 2058 of the Civil Code.
Therefore, in cases of employment "pirated" and healing in cases of acquisition, under art. 43 del testo unico dell’espropria-zione, il risarcimento deve essere commisurato al valore del bene nel momento in cui il proprietario "perde" il proprio diritto sulla cosa.
Il citato articolo 43, al comma 6, detta, con riferimento alla determinazione del risarcimento del danno, alcune regole che, attentamente interpretate, risultano conformi a detti principi, ancorché la formula della disposizione presenti, sul piano letterale, alcune incertezze.
"6. Salvi i casi in cui la legge disponga altrimenti, nei casi previsti nei precedenti commi il risarcimento del danno è determinato:
a) nella misura corrispondente al valore del bene utilizzato per scopi di pubblica utilità e, se l'occupazione riguarda un terreno Building on the basis of Article 37, paragraphs 3, 4, 5, 6 and 7;

The characterization of interest as a "default" is explained, meanwhile, called as the heritage of the legislative framework, introduced in the context of employment in appropriate array of case law.
Moreover, the qualifications made by the law are not binding on the interpreter and, for some time, have been reminder of the considerable difficulties of properly framing the various hypotheses of interest for late payment, fees and compensation.
addition, the rule si spiega considerando che, sin dall’inizio dell’occupazione senza titolo, l’amministrazione versa in una situazione illecita, causando un danno che deve essere risarcito, anche nella componente correlata al ritardo nel pagamento della somma dovuta.
Nel comma 6, poi, il riferimento al "valore del bene utilizzato" esprime il principio di necessaria reintegrazione del pregiudizio subito dal proprietario e non intende fissare alla data dell’inizio dell’utilizza-zione del bene l’esatta commisurazione del danno.
Sul piano sistematico, si è osservato che l’articolo 43 configura l’illecito (costituito dall’occupazione del bene e alla sua utilizzazione per scopi di interesse pubblico) as permanent, unlike the situation in employment appropriate traced back to the category of the offense instantly.

In this case, however, the administration has not taken any action under the said Article 43.
The ruling appealed, with res judicata ruling, stated that the property right is extinguished only concerned with the proposition of the question, involving the request for waiver and refund to the same right of ownership.
This reading of the story is fully in line with an established interpretative guidance (approach which emerged even before the entry into force of Article 43), that in cases of employment "pirated" the individual retains ownership of the property, regardless of the realization of the public.
However, to ensure effective and full protection, the ordinary law (even indirectly endorsed by the Constitutional Court, with the sentence No 191/2006), has long affirmed the principle that you can always opt for the monetary compensation , giving up the return of the property.
So, it is realized in that moment that the "loss" of the value of property arising from a subsequent choice, however, the fraud perpetrated by the administration.
In this perspective, the amount of money that belongs to the person by way of compensation must replace the value of the property that the administration does not return to the person.
Accordingly, reference should be made at that time to determine the market value of the asset and compute the damages.
The monetary value of the property, so determined, will then be reassessed, according to the general principles for compensation at the time of delivery of the decision.
Secondly, the party appellant seeks compensation for the damage on the non-use of the property, which covers the period of occupation without title of the property.
In this regard, the applicant states that the sentence appeal has failed to rule and asked to determine this head of loss through the application of statutory interest on the sum as liquidated damages resulting in the loss of property value.
Even this application is based, for the reasons set out below.
The theme from the appellant is part of a wider range of damages and its relation to the revaluation and legal interests.
In this frame of reference, then, opens up the more specific issue of identification of items of damages in case of different designs with employment, employment pirate and, now, "acquire healed," governed by Article 43 of the Consolidated expropriation.
This rule, although not directly applicable in this case (frame, if at all, in employment, as appropriate, for the reasons stated above) shall take important systematic importance, especially in the part concerning the obligation to pay the "default interest" .
The use of property without title to private property normally involves two separate damages, which are both compensated, especially in light of the principles espoused by the European Court of Human Rights (ECHR) concerning the necessary integrity refreshment of the injury resulting from illegal activities of the administration
Il primo attiene alla perdita (definitiva) della proprietà, che avviene nel momento in cui è adottato il provvedimento di cui all’articolo 43 del testo unico o quando il privato "rinuncia" alla proprietà.
Il secondo danno riguarda la mancata utilizzazione del bene (o del suo corrispondente valore monetario) per il periodo compreso tra l’inizio dalla occupazione senza titolo e la perdita della proprietà.
Tale seconda voce di danno, espressamente richiesta dall’inte-ressato in primo grado, deve essere risarcita, in modo pieno e completo, ma, ovviamente, senza determinare duplicazioni o sovrapposizioni con il ristoro già insito nel risarcimento calcolato sulla perdita del bene, opportunamente reassessed.
For the purposes of the liquidation, appellant argues that the party should be given the interests of "default", referred to in said Article 43, paragraph 6. The

perspective in pointing out, without retracing the entire complex issue of the reconstructive method of calculation of statutory interest on the sum paid by way of damages, it is useful to provide some clarification.
According to a traditional address, statutory interest on the amount due as compensation for the damage they act to compensate for the delay in the debtor fulfills his obligation to make reparation, rising since the time of committing the offense.
According to another interpretation, however, the statutory interest represents the equivalent of the "fruits" of the civil fine, which, under a reasonable assumption can be compared precisely to the legal rate of interest on the equivalent of good money.
In the context of Article 43 and in this case the second option is preferable interpretation, since the obligatory go-compensation on the loss of the property is located only at the time of adoption of the measure of healing acquisition or renunciation of restitution mind, interest shall accrue from an earlier era. The
approved permanent structure of the offense, in fact, does not prevent to distinguish between two distinct phases: the first deals with the Administration without good title, while the second is permanently deprived of the private ownership of the property.
The grading of the obligation for interest in this frame, corresponding to the request of the appellant, entails a further consequence, for the determination of the reference value of "capital".
It may not match the value of the property at the time of the loss of property, but must be determined based on the value of the asset in each year of employment without the title. With
third reason, Part appellant complains that the court failed to ascertain, in an unbiased manner, the market value of the property, leaving the settlement to the administration itself. As a matter of the appellant, it is necessary to make the necessary findings, using the technical consultant.
This complaint is well founded.
It is true that the instrument of Article 35 of Legislative Decree No 80/1998, with a view to speeding up and simplification of the case allows the court to confine itself to establish the criteria for determining injury, leaving the administration with the task of offering the victim a sum fixed by the application of such fees.
However, if present, there is a conflict between the parties regarding the same method for calculating the heads of damage, it is necessary a special investigation technique.
Therefore, for purposes of determining the fair market value of the property, it is essential to the accomplishment of specific technical consultant in the manner indicated below, with submission to the assessor designating the following questions:
"Tell the CTU, taking account of all the pleadings and documents and acts performed by the parties, after the ritual exchange, and any necessary technical investigations, carried out with reasonable notice to the parties:
1) what the market value of the property, according to the criteria of Article 43 of the consolidated text of the expropriation, the time of notification of the action of First Instance as well as of the beginning of time (December 21, 2001);
2) what were the mean changes of property value during the period between the two dates in paragraph 1, indicating the average size of the property value, duly revalued, in relation to each reference year;
3) what is the extent of legal interest related to values \u200b\u200band each of the periods indicated in the preceding paragraphs 1) and 2). "
The aforementioned technical advice, to be carried out without the presence of the Judge, shall indicate clearly results and final conclusions in a written report with the documents deemed necessary for establishing the above. Under Article
. 201 / 1 Code of Civil Procedure, the parties may appoint their own expert witnesses until the time of initiation of operations of CTU, to which the same expert witnesses and advocates can take action within the meaning and effect of art. 194 / 2 CCP.
To this end, the expert appointed by this Council, under Articles. 90 and 91 avail. att. Code, notify the parties made at such address, and, if any expert witnesses, the date of commencement of operations expert and this at least 5 days before. For
l’espletamento dell’incarico, il consulente tecnico potrà chiedere chiarimenti alle parti, assumere informazioni da terzi e svolgere tutte le indagini ritenute necessarie.
Nella camera di consiglio dell’11 marzo 2009 ore 10, il C.T.U. designato presterà giuramento, come da separato verbale.
Le spese saranno liquidate con la sentenza definitiva.
Da ultimo, la parte appellante contesta la pronuncia relativa alla compensazione delle spese del giudizio.
Tale aspetto della lite, peraltro, dovrà essere deciso all’esito della disposta consulenza tecnica.
Pertanto, l’appello deve essere accolto nei sensi sopra precisati
Ai fini della determinazione del danno dovranno essere valutate le risultanze della disposta consulenza tecnica di ufficio.
Per Questi Motivi
Il Consiglio di Giustizia Amministrativa per la Regione Siciliana, non definitivamente pronunciando, accoglie l'appello, nei sensi indicati in motivazione;
dispone gli incombenti istruttori indicati in motivazione;
